Terms & Conditions

From this point onwards, in these terms:

  • Costume King (ABN 29 123 996 413) will be referred to using the terms ‘we’, ‘us’, ‘our’.

  • costumeking.com.au, as well as any other websites we operate with the same domain name will be referred to using the term ‘the Website’.

By using or placing an order with the Website, you indicate your acceptance of the terms and conditions below. Please cease using the Website if you do not agree with the terms and conditions below.

These terms and conditions shall supersede any other terms or conditions stated within the Website. We reserve the right to make changes to the below terms and conditions at our own discretion.

1. Product pricing

     (a) Prices:

           (i) Are per product unless stated otherwise;

           (ii) In non-Australian currency figures are all approximations based on an exchange rate; and

           (iii) May be subject to change before purchase.

     (b) Pricing errors - If you have purchased an order with an error or inaccuracy in pricing:

           (i) We will inform you as soon as possible;

           (ii) You will then have the option of purchasing your order at the correct price; or

           (iii) Cancelling your order with the amount charged being credited back to your original method of payment. 

2. Delivery/shipping costs

     (a) Delivery/shipping costs are added to your order at checkout.

     (b) Free standard and free express shipping:

           (i) Is calculated based on subtotal, excluding shipping; and

           (ii) Is only eligible for orders within 3kg and within a size which does not incur extra charges.

     (c) Orders exceeding over 3kg or not within a size which does not incur extra charges:

           (i) Are charged by weight and postcode; and

           (ii) Are ineligible for free standard and express shipping.

     (d) International orders may be subject to local customs or import duties.

           (i) You are responsible for paying all local customs or import duties.

           (ii) For further information on these fees, contact your local customs office.

3. Promotions, clearances and discounts

     (a) Promotions, clearances and discounts:

           (i) Are only valid within the specified time period if any;

           (ii) Are calculated based on subtotal, excluding shipping;

           (iii) Unless otherwise specified, may not be combined or stacked with other promotions, clearances and discounts; and

           (iv) May be subject to change before you make an order.

4. Payment

     (a) Your order is not confirmed until we have received the entire cleared payment for the order.

     (b) If payment is not received within 24 hours, we reserve the right to cancel the order.

     (c) Payment providers - We may operate payments via third-party payment providers like PayPal and Apple Pay.

           (i) Payment processing may be subject to the terms, conditions and privacy policy of these payment providers in addition to our terms, conditions and privacy policy.

           (ii) We are not liable for the performance and security of payment providers.

5. Dispatch

     (a) Most orders will be dispatched within 24 hours of clearing the payment.

           (i) In cases of significant delays, we will try to notify you.

           (ii) We do not dispatch on weekends or public holidays (Australia Victorian public holidays).

           (iii) Order tracking numbers will be supplied via automated email once dispatched.

6. Delivery

       (a) Delivery times

           (i) Delivery services do not deliver on weekends or public holidays.

           (ii) All delivery times stated are only an estimation. Deliveries to rural areas and parcel lockers may have longer delivery times.

           (iii) Delivery services do not offer delivery guarantees.

     (b) Changes in address

           (i) Contact us immediately if you wish to change your address details.

           (ii) Items may not be redirected to an alternative address once the item has been dispatched.

           (iii) Re-delivery fees may apply if you wish to deliver to an alternative address after dispatch.

     (c) Failed delivery - If you are unavailable at the time of delivery:

           (i) Your order may be taken to the delivery service’s local depot or re-delivered at a later date.

           (ii) If you are unable to receive or pick up your order within the timeframe specified, your order may be returned to us. In that case you can either:

                (1) Contact us and arrange for re-delivery at your own cost.

                (2) Contact us and cancel your delivery. The amount charged excluding deliver/shipping costs will be credited back to your original method of payment.

           (iii) We are not liable in the case that you do not receive your safe drop service orders.

     (d) International orders: We reserve the right to refuse international orders.

           (i) International orders may be subject to local customs or import duties.

                (1) You are responsible for paying all local customs or import duties.

                (2) For further information on these fees, contact your local customs office.

7. Cancelling orders

     (a) Cancellation of order by you

           (i) You must contact us to receive prior approval.

           (ii) If you cancel your entire order before dispatch:

                (1) The amount charged will be credited back to your original method of payment.

                (2) Your order will be cancelled and no longer delivered.

                (3) Once order is dispatched, you can no longer cancel your order. In this case, you may return the order, once you receive it.

     (b) Cancellation of order by us - We reserve the right to cancel your order or part of your order for any reason. If this happens:

           (i) We will notify you as soon as possible.

           (ii) The amount charged will be credited back to your original method of payment.

           (iii) Your order will be cancelled and no longer delivered.

8. Returns

     (a) The return process is as follows:

           (i) You must contact us within 30 days of purchase to receive approval to send your return item.

           (ii) You will receive a ‘RETURN FORM’ and ‘RMA number'.

           (iii) You will complete the ‘RETURN FORM’ and place it inside the return parcel, along with the item you wish to return, and ship it to us.

                (1) Return items without trackable service are sent at your own risk.

                (2) International returns must be returned via trackable service.

                (3) If return items sent without trackable service are lost, your return will be abandoned and you will not be refunded.

                (4) Return shipping is to be covered by the buyer.

           (iv) Kindly notify us when the return arrives at our premise to speed up the return process.

           (v) Once we receive your return and confirm it satisfies all conditions in clause 8(c) and clause 8(d), we will notify you if your return has been approved for a refund (see clause 9). This takes 5 to 10 business days.

           (vi) If we confirm the return item is also factory faulty (see clause 8(e)), we will provide an additional full refund of delivery/shipping fees.

           (vii) If we receive your return item and it does not satisfy all conditions in clause 8(c) and clause 8(d), we will contact you and you will have the choice of either:

                (1) Abandoning the return; or

                (2) Having the return item delivered to you at your own cost.

           (viii) Any returns without a ‘RETURN FORM’ and ‘RMA number’ are subject to refusal at your own cost.

     (b) Walk-in-store return:

           (i) You are welcome to personally return your item to our premise.

           (ii) Contact us for a ‘RETURN FORM’ and fill it in.

           (iii) Find your way to our premise with your ‘RETURN FORM’ and return item.

     (c) Items are only eligible for returns if:

           (i) The item is unused, unworn, unmodified and undamaged;

           (ii) The item packaging and tags are unmodified and undamaged; and

           (iii) Fragrances such as perfumes or deodorant have not been applied to the item.

     (d) We do not provide returns for the items below:

           (i) Sale items listed in the ‘Clearance’ store category;

           (ii) Inflatable items and piggyback/ride-on costumes;

           (iii) Candy bowls & large decor items;

           (iv) Pet costumes and accessories;

           (v) Special orders and mascots; and

           (vi) Items which are excluded for hygiene reasons, including but not limited to:

                (1) Undergarments (i.e. hosiery, stockings, socks, leggings, tights, etc);

                (2) Wigs and wig caps;

                (3) Body & facial hair products (i.e. beards, moustaches, eyelashes, etc);

                (4) Prosthetic products (i.e. fangs, fake teeth, tongues, fake horns, etc);

                (5) Cosmetics and make-up (i.e. theatrical effects, fake blood, etc);

                (6) Temporary tattoos, fake tattoos;

                (7) Jewellery (i.e. piercings, earrings, etc); and

                (8) Contact lenses.

     (e) Factory faulty items

           (i) All items have been checked before dispatch to ensure they are in good condition.

           (ii) If you believe your item is factory faulty, you must contact us within 2 days of receiving the product to receive confirmation that your order is factory faulty.

           (iii) Claims that your item is factory faulty may be subject to refusal after 2 days of receiving the product.

           (iv) Factory faulty items must satisfy all conditions in clause 8(c) unless agreed upon by us.

           (v) An item is not considered factory faulty if

                (1) It is faulty due to fair wear and tear;

                (2) You have failed to use it in accordance with the manufacturer’s instructions;

                (3) You have failed to take reasonable care; or

                (4) Its size does not suit you unless item sizing deviates significantly from what is stated on the Website.

     (f) Exchanging an item

           (i) If you would like to change an item or product size, simply place another order and request a return.

     (g) We reserve the right to refuse returns unless they are factory faulty.

9. Refunds

     (a) Once a return has been approved, we offer 110% store credit of the item sale price or a item sale price refund.

     (b) Choosing 110% store credit gives you a bonus 10% in value of the item sale price to spend in addition to the refunded amount.

           (i) The store credit will be issued onto your store account and can be used in future purchases.

           (ii) Store credits cannot be refunded or exchanged for cash.

           (iii) Items purchased with 110% store credit cannot be refunded either for cash or a further incremental 110% credit.

           (iv) The store credit cannot be moved from one store account to another store account.

     (c) Original and return shipping is non-refundable.

10. Disclaimer

     (a) All services and information provided are on an ‘as in’ basis without warranties of any kind, whether implied or expressed, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

     (b) We regularly update the Website to ensure as much information as possible is as up to date and correct. However, we do not warrant the completeness, accuracy or reliability of any information contained on the Website. Any use of information contained on the Website is at your own risk.

     (c) While we make our best attempt to maintain the security of the Website, under no circumstances will Costume King be liable for consequential loss or damage to computer systems, mobile phones or any other electronic devices as a result of connection with use of the Website. You should take your own precautions to reduce risk of exposure to viruses, data loss, malicious software or other forms of interference.

     (d) You authorise us to use, store or process any information including personal information to the extent reasonably necessary for the provision of any products requested by you, and for any other purposes we consider reasonable. Such use will be compliant with the terms of our Privacy Policy.

     (e) We may change the contents, operation, or features of the Website or withdraw from the Website at our own discretion.

     (f) These terms are effective until terminated by either party. You may terminate these terms at any time by ceasing use of the Website.

     (g) If any provision in these terms are found to be unenforceable, that provision shall be severed, with all other terms remaining in full force and effect.
